symboles?\u00a0<\/b><\/h5><p><span style=\"font-weight: 400;\">MC<\/span><span style=\"font-weight: 400;\"> : marque de commerce = \u2122 : Trademark<\/span><\/p><p><span style=\"font-weight: 400;\">MD<\/span><span style=\"font-weight: 400;\"> : marque d\u00e9pos\u00e9e = \u00ae : Registered Trademark\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">L\u2019ensemble de ces symboles informent le public que vous \u00eates propri\u00e9taire de la marque en question, ce qui peut avoir comme effet b\u00e9n\u00e9fique de dissuader les contrevenants.<\/span><\/p><h5>\u00a0<\/h5><h5>Sont-ils obligatoires?<\/h5><p><span style=\"font-weight: 400;\">Bien que la <a href=\"https:\/\/laws-lois.justice.gc.ca\/fra\/lois\/t-13\/\" target=\"_blank\" rel=\"noopener\">Loi sur les marques de commerce du Canada<\/a> ne comporte aucune exigence concernant le marquage, il est avantageux d\u2019utiliser les symboles appropri\u00e9s afin de pr\u00e9venir la contrefa\u00e7on et dissuader les contrevenants potentiels.<\/span><\/p><p><span style=\"font-weight: 400;\">En effet, au Canada, vous n\u2019\u00eates pas tenus d\u2019utiliser syst\u00e9matiquement le symbole \u00ae afin que vos droits sur votre marque soient reconnus. Dans tous les cas, une marque de commerce devrait \u00eatre accompagn\u00e9e le plus souvent possible de l\u2019un de ces symboles.<\/span><\/p><p><span style=\"font-weight: 400;\">Toutefois, dans certains pays, comme les \u00c9tats-Unis, l&rsquo;utilisation du symbole peut \u00eatre une condition pr\u00e9alable \u00e0 l\u2019obtention de certains dommages-int\u00e9r\u00eats, ou est m\u00eame parfois indispensable pour que le titulaire de la marque puisse \u00eatre en mesure de d\u00e9poser une action en contrefa\u00e7on.<\/span><\/p><h5>\u00a0<\/h5><h5>Pourquoi utiliser ces symboles?<\/h5><p><span style=\"font-weight: 400;\">M\u00eame si l\u2019utilisation d\u2019un symbole de marquage ne garantit pas que la marque sera prot\u00e9g\u00e9e contre la contrefa\u00e7on, il permet, entres autres, de :<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Fournir un avis de possession de droits de marque de commerce<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Dissuader les concurrents qui pourraient \u00eatre tent\u00e9s d&rsquo;utiliser la m\u00eame marque ou une marque semblable<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Distinguer la marque du texte environnant<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">D\u2019\u00e9viter de limiter les recours disponibles dans une action en justice<\/span><\/li><\/ul><h5>\u00a0<\/h5><h5>Quel symbole devrait \u00eatre utilis\u00e9?<\/h5><p><span style=\"font-weight: 400;\">Les symboles MC (version fran\u00e7aise) et TM (version anglaise) peuvent \u00eatre utilis\u00e9s par un propri\u00e9taire qui d\u00e9sire aviser le public qu\u2019il d\u00e9tient les droits sur sa marque de commerce, qu\u2019elle soit en voie d\u2019\u00eatre enregistr\u00e9e ou non.<\/span><\/p><p><span style=\"font-weight: 400;\">Les symboles MD (version fran\u00e7aise) ou \u00ae (version anglaise) ne peuvent quant \u00e0 eux \u00eatre appos\u00e9s pr\u00e8s de la marque de commerce que lorsque le processus d\u2019enregistrement est termin\u00e9 et que le certificat d\u2019enregistrement a \u00e9t\u00e9 \u00e9mis.<\/span><\/p><p><span style=\"font-weight: 400;\">En r\u00e8gle g\u00e9n\u00e9rale, tant que les marques ne sont pas enregistr\u00e9es, vous devez utiliser les symboles MC ou TM. De plus, il est important de savoir que l\u2019utilisation des symboles MD ou \u00ae \u00e0 proximit\u00e9 d\u2019une marque non enregistr\u00e9e peut entra\u00eener de graves r\u00e9percussions aux \u00c9tats-Unis, notamment des accusations de fraude.<\/span><\/p><p><span style=\"font-weight: 400;\">Donc, il est conseill\u00e9 d\u2019ajouter les symboles MC et\/ou TM dans les pays o\u00f9 la marque de commerce n\u2019est pas enregistr\u00e9e. Une fois l&rsquo;enregistrement accord\u00e9, il sera possible de remplacer ces symboles par MD ou \u00ae.<\/span><\/p><h5>\u00a0<\/h5><h5>Comment utiliser correctement ces symboles?<\/h5><p><span style=\"font-weight: 400;\">De mani\u00e8re g\u00e9n\u00e9rale, le symbole appropri\u00e9 doit appara\u00eetre en exposant dans le coin sup\u00e9rieur droit d&rsquo;une marque. Si ce n\u2019est pas techniquement ou esth\u00e9tiquement possible de le placer \u00e0 cet endroit, celui-ci devrait \u00eatre ajout\u00e9 dans le coin inf\u00e9rieur droit de la marque.\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">Il ne faut pas abuser de ces symboles dans les documents \u00e9crits (article, document promotionnel, documentation corporative, communiqu\u00e9 de presse, etc.) puisque ceci cr\u00e9e de l&rsquo;encombrement visuel et peut nuire \u00e0 l&rsquo;attrait esth\u00e9tique du document sans offrir d\u2019avantage juridique suppl\u00e9mentaire.
