pr\u00e9c\u00e9dent, quand vient le temps de <a href=\"https:\/\/gomintbox.ca\/marques-de-commerce\/protection-des-marques-de-commerce\">pr\u00e9parer une demande d&rsquo;enregsitrement<\/a> de marque de commerce, le choix des produits et services qui seront inclus est tr\u00e8s important.<\/span><\/p><p>Le R\u00e8glement canadien exige que les \u00e9nonc\u00e9s de produits ou de services d\u00e9crivent chacun de ces produits ou services d&rsquo;une mani\u00e8re qui identifie un bien ou un service sp\u00e9cifique et doivent \u00eatre class\u00e9s selon le <a href=\"https:\/\/www.wipo.int\/classifications\/nice\/fr\/\" target=\"_blank\" rel=\"noopener\">syst\u00e8me de classification de Nice<\/a>.<\/p><p><span style=\"font-weight: 400;\">L&rsquo;<a href=\"https:\/\/www.ic.gc.ca\/eic\/siTe\/cipointernet-internetopic.nsf\/fra\/h_wr00002.html\" target=\"_blank\" rel=\"noopener\">Office de la propri\u00e9t\u00e9 intellectuelle du Canada (OPIC)<\/a> est (beaucoup) plus exigeant que d\u2019autres Offices quant \u00e0 la sp\u00e9cificit\u00e9 de la description des produits et services. En effet, plusieurs termes acceptables dans d\u2019autres juridictions ne sont g\u00e9n\u00e9ralement pas consid\u00e9r\u00e9s comme acceptables au Canada et les intitul\u00e9s de classe ne sont pas suffisants. L&rsquo;examinateur canadien exigera que les produits et services soient d\u00e9crits selon les normes canadiennes.<\/span><\/p><p><span style=\"font-weight: 400;\">Les exemples probl\u00e9matiques suivants sont largement utilis\u00e9s au niveau international:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">\u00abV\u00eatements\u00bb est un terme ordinaire du commerce, mais il n&rsquo;identifie pas un produit sp\u00e9cifique. Des exemples comme \u00abv\u00eatements d\u00e9contract\u00e9s\u00bb ou des \u00abv\u00eatements pour enfants\u00bb seraient des choix acceptables puisque le type de v\u00eatements fonctionnels a \u00e9t\u00e9 fourni.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Un \u00ablogiciel\u00bb sans autre sp\u00e9cification donnerait au d\u00e9posant un champ de protection d\u00e9raisonnablement large. De mani\u00e8re g\u00e9n\u00e9rale, la fonction sp\u00e9cifique du logiciel et le domaine d&#8217;emploi (s\u2019il n\u2019est pas \u00e9vident) doivent \u00eatre indiqu\u00e9s.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Les \u00abproduits m\u00e9dicaux ou pharmaceutiques\u00bb devront sp\u00e9cifier la maladie, le type de maladie, de trouble ou d&rsquo;affection \u00e0 traiter, ou indiquer le type sp\u00e9cifique de m\u00e9dicament.<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">Le crit\u00e8re \u00e0 trois volets suivant est appliqu\u00e9 pour d\u00e9terminer si la liste des produits et services est consid\u00e9r\u00e9e assez sp\u00e9cifique:<\/span><\/p><ol><li><span style=\"font-weight: 400;\"> Les produits ou services sont-ils assez sp\u00e9cifiques pour permettre de d\u00e9terminer si la marque donne une description claire de la nature ou de la qualit\u00e9 des produits ou services?<\/span><\/li><li><span style=\"font-weight: 400;\"> Les produits ou services sont-ils assez sp\u00e9cifiques pour s\u2019assurer que le requ\u00e9rant n&rsquo;obtiendra pas une protection trop \u00e9tendue?\u00a0<\/span><\/li><li><span style=\"font-weight: 400;\"> Les produits ou services sont-ils assez sp\u00e9cifiques pour permettre d&rsquo;\u00e9valuer la confusion?\u00a0<\/span><\/li><\/ol><p><span style=\"font-weight: 400;\">L&rsquo;OPIC a mis en ligne son <a href=\"https:\/\/www.ic.gc.ca\/app\/scr\/ic\/cgs\/ext\/accueil.html?lang=fra\" target=\"_blank\" rel=\"noopener\">Manuel des produits et services<\/a>. Vous y trouverez divers exemples de descriptions acceptables et des termes
